1. Acceptance of Terms

By accessing and using Stacco App ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this App.

2. Apple End User License Agreement

If you access the App via an Apple device, you acknowledge and agree that:

• These Terms are concluded between you and Stacco App only, and not with Apple Inc. ("Apple"). Stacco App, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to furnish any maintenance and support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
• In the event of any third party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
• Apple and Apple's subsidiaries are third party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
• You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).

3. Use License

Permission is granted to temporarily download one copy of Stacco App for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the App materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained in the App
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password.

5. Subscriptions and Payments

Some features of the App are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").

Subscription Plans

We offer the following subscription plans:

• Weekly Plan: $2.99 USD per week
• Monthly Plan: $9.99 USD per month
• Yearly Plan: $69.99 USD per year

Prices are subject to change with notice. Your subscription will be charged to your Apple ID account at confirmation of purchase. All prices include applicable local taxes.

Payment Processing via RevenueCat

All subscription payments are processed through RevenueCat, a third-party subscription management service, in conjunction with Apple's in-app purchase system. By subscribing, you agree to RevenueCat's processing of your subscription data and Apple's payment terms.

RevenueCat acts as our subscription infrastructure provider and handles subscription status, receipt validation, and subscription analytics. Your payment information is securely processed through Apple's payment system and is not directly handled or stored by Stacco App.

Automatic Renewal

At the end of each Billing Cycle, your Subscription will automatically renew unless you cancel it or we cancel it. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

You may cancel your Subscription renewal at any time through your Apple ID account settings. You must cancel at least 24 hours before the end of the current subscription period to avoid being charged for the next period. Cancellation takes effect at the end of the current billing period.

Managing Your Subscription

You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Instructions for managing subscriptions can be found at:

6. Refund Policy

Refunds are handled through Apple's App Store refund policies. If you are not satisfied with your subscription, you may request a refund directly from Apple within the applicable refund period.

To request a refund from Apple, visit https://support.apple.com/en-us/HT204084 or contact Apple Support. Please note that Stacco App does not have control over Apple's refund decisions.

7. Prohibited Uses

You may not use the App:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the Company, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful

8. Health and Medical Disclaimer

IMPORTANT: Stacco App is a fitness and workout tracking application designed to help you monitor and plan your exercise routines. It is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition.

Consult Your Doctor

Before beginning any exercise program or using this App, you should consult with your physician or other qualified healthcare provider, especially if you:

• Have any pre-existing medical conditions
• Are pregnant or nursing
• Are taking any medications
• Have a history of heart disease or high blood pressure
• Have any injuries or physical limitations
• Are over the age of 45 and sedentary
• Experience any pain, discomfort, or other symptoms

Exercise Risks

Exercise and physical activity carry inherent risks. By using this App, you acknowledge and assume all risks associated with physical exercise, including but not limited to:

• Physical injury, including muscle strains, sprains, fractures, or more serious injuries
• Cardiovascular events
• Aggravation of pre-existing conditions
• Other health complications

Your Responsibility

You are solely responsible for determining whether any exercise program or activity suggested by the App is appropriate for your fitness level and health status. You should:

• Stop exercising immediately if you feel faint, dizzy, experience pain, or have difficulty breathing
• Seek immediate medical attention if you experience any adverse symptoms
• Use proper form and technique when performing exercises
• Not exceed your physical limitations or ignore pain signals from your body
• Ensure you exercise in a safe environment with appropriate equipment

No Medical Advice

The content provided through the App, including workout plans, exercise suggestions, and any health-related information, is for informational and educational purposes only. It does not constitute medical advice and should not be relied upon as a substitute for professional medical consultation, diagnosis, or treatment.

Stacco App and its creators, employees, and affiliates are not licensed healthcare providers and do not provide medical advice. Always seek the advice of your physician or qualified healthcare provider with any questions you may have regarding a medical condition or exercise program.

Limitation of Liability for Health Issues

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACCO APP SHALL NOT BE LIABLE FOR ANY INJURIES, DAMAGES, OR HEALTH ISSUES THAT MAY RESULT FROM YOUR USE OF THE APP OR PARTICIPATION IN ANY EXERCISE PROGRAM. YOU EXPRESSLY WAIVE ANY CLAIMS AGAINST STACCO APP ARISING FROM PHYSICAL INJURY OR HEALTH COMPLICATIONS RELATED TO YOUR USE OF THE APP.

9. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Stacco App and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

10. General Disclaimer

The App is provided on an "as is" and "as available" basis. Stacco App makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

11. Limitation of Liability

In no event shall Stacco App or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
